Terms of Service

These Terms of Service ("Terms") govern your use of MOOODs ("MOOODs," "we," "us") — the website, product, and any related services (the "Service"). By using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What MOOODs does

MOOODs takes a business name and description and generates a social media strategy, an inspiration mood board sourced from real public social media content, and content scripts, using AI and third-party data sources. It also offers weekly trend-update emails and a collaborative canvas for reviewing and tracking content ideas.

2. Eligibility and accounts

  • You must be at least 16 years old to use the Service.
  • If you create an account, you're responsible for the accuracy of your account information and for keeping your login credentials secure. You're responsible for activity that happens under your account.
  • You may use the Service on behalf of a business you're authorized to represent.
  • Authorized MOOODs personnel may view your account's plan, usage, and status to provide support and operate the Service — see our Privacy Policy for details.

3. Free trial and anonymous use

The Service currently allows one free board generation without an account. To prevent abuse, we track this using a browser cookie and a limit on generations per IP address over a rolling time window — attempting to get around these limits (for example, by repeatedly clearing cookies, using private browsing to request more free generations, or automating requests to the generation endpoint) is a violation of these Terms and may result in your access being blocked. We may change, limit, or end free/anonymous access at any time.

4. Plans, billing, and payment

Current plans, pricing, and features are listed on our Pricing page and may change with reasonable notice to existing subscribers. The following applies once paid plans are available:

  • Subscriptions bill on a recurring basis (e.g. monthly) and automatically renew until cancelled.
  • Payment is processed by a third-party payment processor. We never see or store your full card number.
  • Prices are shown exclusive of applicable taxes unless stated otherwise; you're responsible for any taxes owed.
  • If you exceed your plan's monthly generation limit, additional generations may be billed at the overage rate listed on the Pricing page for your plan, or your account may be paused until your next billing cycle, at our discretion.
  • We'll give existing subscribers reasonable advance notice before a price increase takes effect for their plan.
  • If a payment fails, we may suspend access to paid features until the issue is resolved, after reasonable notice.

5. Cancellation and refunds

  • You may cancel your subscription at any time from your account settings (once available) or by contacting us. Cancellation takes effect at the end of your current billing period — you keep access until then.
  • Fees already paid are non-refundable, including for partial billing periods.
  • We do not prorate or refund unused generations, credits, or time if you downgrade or cancel mid-cycle.
  • We may, at our sole discretion, issue refunds on a case-by-case basis.

6. Acceptable use

You agree not to:

  • Use the Service for anything illegal, or to generate content that is illegal, infringing, defamatory, or intended to harm others.
  • Attempt to bypass usage limits, rate limits, or the free-trial gate, including via multiple accounts, automation, or scripted requests.
  • Scrape, reverse-engineer, or attempt to extract the Service's underlying models, prompts, or source code, beyond what applicable law expressly permits.
  • Resell, sublicense, or provide the Service to third parties as your own product without our written permission.
  • Interfere with or disrupt the integrity or performance of the Service, including its infrastructure.

We may suspend or terminate access for violating this section, with or without notice depending on severity.

7. Your content and our license to it

  • You retain ownership of the business information you submit and the strategy, scripts, and boards generated for you.
  • You grant MOOODs a license to host, process, store, and display your content solely to provide and improve the Service.
  • MOOODs and its licensors own the platform itself — the software, design, and underlying technology. Nothing in these Terms transfers that ownership to you.
  • If you send us feedback or suggestions, you agree we may use them without any obligation to you.

8. AI-generated content — read this before you rely on it

Strategies, audience profiles, competitor research, platform rankings, scripts, and other outputs are generated using AI models and third-party data sources, and may be incomplete, outdated, or inaccurate — including claims about specific competitors, trends, or platforms. You're responsible for reviewing and independently verifying any content before relying on it or publishing it. Nothing generated by the Service constitutes legal, financial, or professional advice.

9. Third-party platforms and content

Inspiration cards reference publicly available posts from TikTok, Instagram, and other platforms. MOOODs does not own, control, or guarantee the accuracy of that content, and view/engagement counts may be cached, delayed, or approximate. MOOODs is not affiliated with, and is not endorsed by, TikTok, Instagram, or any other platform referenced in the Service.

10. Sharing boards

The share-link feature grants anyone who has the link the ability to view a board, without needing an account. You're responsible for who you share a link with — treat it like you would any other link to content you don't want publicly indexed.

11. Service availability

The Service is provided "as is" and "as available." We don't guarantee it will be uninterrupted, error-free, or available at all times, and we may modify or discontinue features with or without notice.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that using the Service will achieve any particular marketing result.

13. Limitation of liability

To the fullest extent permitted by law, MOOODs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose (or, if you haven't paid us anything, to $100 USD).

14. Indemnification

You agree to indemnify and hold MOOODs harmless from any claims, damages, or expenses arising from your misuse of the Service or your violation of these Terms.

15. Termination

You may stop using the Service, or cancel your subscription, at any time. We may suspend or terminate your access for violating these Terms, for non-payment, or if we discontinue the Service, with notice where reasonably practical.

16. Changes to these Terms

We may update these Terms as the Service changes. We'll update the "Last updated" date above, and for material changes we'll make a reasonable effort to give notice. Continuing to use the Service after changes take effect means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of [STATE/COUNTRY — to be finalized upon incorporation], without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the courts located in [STATE/COUNTRY].

18. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and MOOODs regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any provision isn't a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger, acquisition, or sale of assets.
